What is an E2 visa?
An E2 business visa allows the visa holder to move to the United States for the purpose of owning and running a business.
If you are a national of an E2 Treaty Country, you can use the E2 Treaty Investor Visa program to move to the U.S. with your spouse and dependent children to invest in and direct business operations. This may be a new business you start, but it could also be an established business that you acquire or decide to franchise.
Before making any decisions or plans, however, it is critical to consult an experienced E2 visa lawyer who can review your business plan, advise you on any potential issues, and help you make more informed decisions.

With an E2 Visa, You will have temporary residency, but no limits on number of renewals
Are there any limits on the number of E2 visas available?
No caps or quotas for E2 Visa, but you must be a citizen of a treaty country
How much would I need to invest for an E2 Visa?
No minimum but usually > $100,000
Would I need to create a business for E2 Investor Visa?
For an E2 Visa you must acquire, invest in, start, or expand a business or franchise.
Does property count as an investment for E2 Visa?
It is possible to set up an E2 qualifying real estate company but it cannot be a “passive investment”
With an E2 Visa, would I be required to create jobs?
For an E2 Visa, no set minimum but 2 jobs are strongly advised.
With an E2 Visa, could I bring my family?
Spouse permitted to work, children can accompany until aged 21
What are the tax implications for E2 Visa?
You would not pay tax on non-US income unless you meet the Substantial Presence Test. Please make an appointment with our tax lawyers.
What are the waiting times for an E2 Visa?
Processing times for the E2 Visa are relatively quick. The E2 visa is processed at US embassies and consulates and applicants do not need to wait for approval by the US Citizenship and Immigration Services (USCIS).
Is cash the only way to make an E2 visa investment?

How long are E2 category visas valid?
The initial period for E2 visas can be up to five years, depending on reciprocity. While the E2 category visa is valid, the visa holder is free to come and go within and outside the U.S.
E2 visas may be renewed indefinitely, if the needs of the underlying business are such that there continues to be a need for the visa holder to manage and direct it.
Can my family move with me on an E2 visa?
The spouse of the E2 Visa holder can move to the United States with the primary applicant. The spouse can apply for e2 visa work authorization to work for any US employer. This offers considerably more employment flexibility than the H-1B visa because it is not tied to any specific employer and can be renewed indefinitely (whereas H-1B is limited to a maximum of 6 years). Dependent children under the age of 21 can also accompany the parents to the United States.

Yes, you can still apply for the US E-2 Treaty Investor Visa regardless of whether you take the Grenada CBI real estate or donation route. There is a commonly held misconception that you are not eligible for an E-2 Visa if you choose the donation route – this is incorrect.
Eligibility for the E-2 Visa is determined by the citizenship of an E-2 Treaty Country Grenada is an E-2 Country and its citizens are eligible for the E-2 Visa, no matter which pathway to citizenship you choose.
